The Focal Point

 

The Focal Point designates the entity of a Party responsible for receiving and submitting information to the other Parties to be notified of any case of import, export or transit of hazardous waste. It is the national reference for the other Parties on all matters relating to the Convention.


 

Role of the Focal Point 

 

The focal point acts as the primary interface between the country and the structures of the Bamako Convention, ensuring that obligations are met, information is communicated to the relevant government departments and other parties, and the Convention’s goals are achieved at the national level.

Designation of Competent Authorities, Focal Point and Dumpwatch

 

As described in Article 15 of the text of the convention, the Parties shall:

  1. Designate or establish one or more competent authorities and one focal point. One competent authority shall be designated to receive the notification in case of a State of transit;
  2. Inform the Secretariat, within three months of the date of the entry into force of this Convention for them, which agencies they have designated as their focal point and their competent authorities;
  3. Inform the Secretariat, within one month of the date of decision, of any changes regarding the designations made by them under paragraph 2 above;
  4. Appoint a national body to act as a Dumpwatch. In such capacity as a Dumpwatch, the designated national body only will be required to coordinate with the concerned governmental and non-governmental bodies.

Responsibilities

 

For the Bamako Convention, each Party is expected to designate a focal point. The responsibilities and roles of the focal point with respect to the Bamako Convention include:

The focal point ensures regular communication with the convention’s Secretariat, transmitting and receiving essential information concerning the treaty’s implementation.
 
It coordinates efforts related to the Bamako Convention within the country, ensuring that various governmental and non-governmental agencies are aligned in their actions and strategies concerning hazardous wastes.
 
The focal point is typically responsible for preparing and submitting national reports on the country’s progress in implementing the Convention’s provisions. This might include data on hazardous waste generation, management, disposal, and any incidents of illegal traffic.
 
Representatives from the focal point usually attend meetings related to the Bamako Convention, such as the Conference of the Parties (COP) and other technical or subsidiary body meetings. 
 
The focal point may play a role in raising awareness about the Convention within the country and organizing or facilitating training programs related to the environmentally sound management of hazardous wastes.
 
While the focal point coordinates and communicates, it also may play a role in monitoring the enforcement of the Convention’s provisions within the country, ensuring compliance and addressing any breaches or illegal activities.
